Terms for the BARAQ app, web administration and cloud services

The service is operated by BARAQ SMART SYSTEMS s.r.o., Company ID 23050055, Úvoz 493/29, Staré Brno, 602 00 Brno, Czech Republic. These terms govern the BARAQ app, web administration, customer account, remote access and cloud services. Hardware delivery and installation may be governed by a separate order or agreement.
Users create an account using an activation key, invitation or other verification linked to an installation. Owners and administrators may invite household members and set their permissions. They must grant access only to authorized persons and remove it when no longer needed. The service must not be used for secret or unlawful monitoring.
The app may physically control doors, gates, security, climate, vehicle charging and other equipment. Users must consider the consequences of commands and automations. Optional location-based functions require device permission. Location accuracy depends on the device, operating system, signal and connectivity, so execution at an exact time or place cannot be guaranteed.
Some features may require a paid cloud service and internet access. The price, billing period, scope, renewal and cancellation method will be shown before purchase. We strive for reliable operation but cannot guarantee uninterrupted availability. Users should install security and compatibility updates within a reasonable time. Statutory consumer rights remain unaffected.
Users must not bypass security, disrupt the service, access another account or installation, distribute malicious code or use the service unlawfully. BARAQ is liable to the extent required by law. Nothing in these terms excludes liability that cannot legally be excluded or limits mandatory consumer rights.
An account can be closed in the app or via info@baraq.cz. This may end remote access, household membership, personal settings and cloud features. Complaints may be submitted to the same email or our registered office. Czech law applies without limiting mandatory rights of consumers in their country of habitual residence.
